These Terms of Use ("Terms") govern your use of the YourSizer website, widget, merchant dashboard and related services (together, the "Service"). The Service is provided by YourSizer Teknolojileri ("YourSizer", "we", "us"), Adnan Kahveci Mah. Osmanlı Cad. Yeşilkent-3 Tanrıverdi Apt. No: 36 İç Kapı No: 64, Beylikdüzü / İstanbul, Türkiye, contact@yoursizer.com. By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

YourSizer is software for online fashion stores. It provides size recommendations, AI virtual try-on and fit analytics. Our customers are businesses ("Merchants") that add the YourSizer widget to their online stores; shoppers use the widget on those stores. Purchases that shoppers make in a Merchant's store are contracts between the shopper and that Merchant, not with YourSizer.

2. Eligibility

You must be at least 18 years old to use AI virtual try-on and at least 16 years old to use the other parts of the Service. Merchant accounts may only be opened by people who are authorised to act for the business they register.

3. Accounts

  • Provide accurate information and keep it up to date.
  • Keep your login details secure. You are responsible for activity carried out through your account.
  • Tell us at contact@yoursizer.com without delay if you suspect unauthorised use of your account.

4. Acceptable Use and Content Safety

You may use the Service only for its intended purpose: helping shoppers choose the right size and see how a real product looks on them. You must not:

  • Upload a photo of anyone other than yourself to AI virtual try-on, or any photo you do not have the right to use.
  • Upload or try to generate nudity, sexual or sexually suggestive content.
  • Upload or try to generate any image of a minor. AI virtual try-on is for adults only.
  • Use the Service to swap, alter or fake a person's face or identity, to create deepfakes, or to impersonate anyone.
  • Upload or try to generate violent, hateful, harassing, defamatory or otherwise illegal content.
  • Infringe the intellectual property or privacy rights of others.
  • Attempt to bypass safety filters, reverse engineer the Service, scrape it, or overload it with automated requests.
  • Spread malware or interfere with the normal operation of the Service.

4.1. How AI virtual try-on works and how we keep it safe

  • Try-on only changes the clothing or accessory in your own photo so you can see how the Merchant's product looks on you. It does not swap or alter faces and it is not a face-manipulation tool.
  • Try-on is not available for swimwear, lingerie, underwear or children's products. This is a fixed safety rule that Merchants cannot switch off.
  • Every prompt text that a Merchant or our team writes for try-on is screened by an automated content-moderation service before any image is generated. Text that is denied or flagged is blocked and never reaches the image model.
  • Images produced by try-on are AI-generated previews. They may not show colour, fit or fabric exactly. Size recommendations and try-on previews are guidance only; the final purchase decision is yours.
  • We may block content, suspend try-on or close accounts that break these rules, and we report illegal content to the authorities where the law requires it.

5. Plans, Payments and Cancellation

  • Prices and plan contents are shown on our pricing page.
  • Merchants who install YourSizer from the Shopify App Store are billed by Shopify.
  • Direct Merchants in Türkiye pay in Turkish lira by card through Sipay, a licensed payment institution. Each payment is confirmed by the Merchant with 3D Secure.
  • Direct Merchants outside Türkiye pay through Creem (Armitage Labs OÜ, Estonia), which acts as Merchant of Record and handles payment, invoicing and applicable taxes.
  • You can cancel at any time from Settings → Billing in your dashboard or by emailing contact@yoursizer.com. Cancellation takes effect at the end of the current billing period.
  • Plan changes and refunds are governed by our Refund Policy.

6. Intellectual Property

The Service, including its software, size-recommendation models, design, text and logos, belongs to YourSizer or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms.

You keep the rights to the photos, measurements and other content you provide. You grant us a limited licence to process that content only to provide the Service to you and to the Merchant whose store you use, as described in our Privacy Policy. We do not use your photos to train AI models. Merchants confirm that they have the rights to the product images and texts they supply.

7. Disclaimers

Size recommendations are estimates based on the measurements you enter and the size data supplied by the Merchant. They do not guarantee a perfect fit: fit also depends on body shape, garment cut, fabric and personal preference. AI try-on images are illustrative previews. The Service is provided "as is" and "as available"; we work to keep it secure and available but cannot guarantee that it will be uninterrupted or error-free.

8. Limitation of Liability

To the extent permitted by law, YourSizer is not liable for indirect or consequential damages, loss of profit or loss of data arising from the use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory law, or any mandatory rights you have as a consumer.

9. Suspension and Termination

We may suspend or end your access to the Service if you breach these Terms, especially section 4, or if the law requires us to do so. You may stop using the Service at any time; Merchants can cancel their subscription as described in section 5.

10. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The İstanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over any dispute arising from these Terms or the Service. If you are a consumer, this does not take away the protection given to you by the mandatory laws of your country of residence, and you may also apply to the consumer arbitration committees and consumer courts competent under Turkish law.

11. Changes to These Terms

We may update these Terms. We will publish the new version on this page with a new "Last updated" date and, for significant changes, inform Merchants by email before the changes take effect.
