Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you and YourSizer Corporation (“YourSizer,” “we,” or “us”) regarding your use of www.yoursizer.com, all websites and domains owned by YourSizer, our mobile application, and any services offered through our website and mobile application (collectively referred to as the “Services”), as well as any content (as defined in Section 2 below).

By accessing or using the Services in any way, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference . If you do not agree with these Terms or our Privacy Policy, you may not use the Services.

These Terms include a class action waiver and jury trial waiver , which means any disputes must be resolved individually and without a jury. See Section 12 for details.

1. Changes to These Terms

YourSizer may revise these Terms at its sole discretion. The date of the most recent revision will appear at the top of this page. Revisions will take effect 30 days after being posted for existing users and immediately for new users. Continued use of the Services constitutes your acceptance of any changes.

2. Scope of Use and Restrictions

Subject to these Terms, YourSizer grants you (a) a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services and related content—including graphics, text, instructions, images, audio, video, and other materials (“Content”)—for your personal, non-commercial use, and (b) if applicable, to download and install our mobile app on your devices.

You agree not to:

• Collect information from the Services using automated tools or manual bulk methods.
• Use automated means to access the Services or gain unauthorized access to systems or accounts.
• Access areas of the Services not intended for you.
• Overload, disrupt, or damage the Services or our infrastructure.
• Interfere with other user's use of the Services.
• Remove or modify any copyright or trademark notices.
• Use the Services or Content for illegal purposes or beyond the scope granted here.

3. Ownership

The Services and all Content are owned by YourSizer or its licensors and are protected by copyright, trademark, and other applicable laws. All trademarks and logos displayed in the Services are property of YourSizer or their respective owners.

4. Account Registration and Security

Some Services require account registration. You agree to provide accurate, current, and complete information, and to maintain the confidentiality of your account credentials. You are responsible for all activity under your account. You must notify us immediately atcontact@yoursizer.com if you suspect unauthorized access.

5. Product Information

• Pricing:All prices are in USD and may change at any time.
• Display:We strive for accuracy, but monitor settings may affect color or appearance.
• Availability:Products may not always be available when revisiting the Services.
• Accuracy:We do our best to provide reliable information, but errors or outdated info may occur.

6. Privacy Policy

Information collected through the Services is governed by our Privacy Policy. By using the Services, you consent to our use of your data in accordance with that policy.

7. Modifications, Suspension, Termination

YourSizer may modify, suspend, or discontinue any part of the Services at any time. We may terminate or restrict your access if you violate these Terms. Upon termination, you must stop using the Services and destroy all downloaded content.

8. Disclaimer; Limitation of Liability

Disclaimer:The Services and Content are provided “as is” and “as available,” without warranties of any kind. YourSizer disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation:Limitation: To the fullest extent permitted by law, YourSizer shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services. Our total liability will not exceed $100 USD.

Expections:Some jurisdictions do not allow exclusions of certain warranties or limitations of liability, so these may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless YourSizer and its affiliates, employees, and agents from any claims or liabilities arising from your use of the Services, any products you order through them, or your violation of these Terms or applicable laws.

10. Third Party Materials

The Services may display or link to third-party content or websites (“Third-Party Materials”). YourSizer is not responsible for the accuracy or legality of such materials. Use them at your own risk.

11. Third-Party Platforms

YourSizer may make Services available via third-party platforms (e.g., social networks). Your use of those platforms may be subject to additional terms, and we are not responsible for any liabilities related to them.

12. Jury Trial and Class Action Waiver

YOU AND YOURSIZER WAIVE THE RIGHT TO A JURY TRIAL. Any dispute must be resolved by a judge. You also agree not to bring or participate in any class action lawsuits or representative claims against YourSizer.

13. User Submission

Unless otherwise agreed in writing or stated in our Privacy Policy, any content you submit to the Services will be considered non-confidential and non-proprietary. YourSizer may use, reproduce, and distribute such content for any purpose. Do not submit illegal, threatening, defamatory, obscene, or otherwise inappropriate material.

14. Miscellaneous

• Geographic Restrictions:The Services are based in the United States. Access outside the Türkiye is at your own risk.
• Governing Law: These Terms are governed by the laws of the Istanbul Türkiye, without regard to conflict of law principles. Disputes will be resolved in the courts of Istanbul, Türkiye.
• Limitation Period:Any claim related to these Terms or Services must be brought within one (1) year.
• Waiver and Severability:If any part of these Terms is found invalid, the rest will remain in effect.
• Entire Agreement: These Terms (including our Privacy Policy) are the entire agreement between you and YourSizer and supersede all prior agreements. We may assign this agreement at our discretion.
